1) Introduction
Welcome to fierceflowdigital.com and our related pages, funnels, and subdomains, including pages hosted via GoHighLevel (the “Website”). These Terms of Use (the “Terms”) are a legal agreement between FierceFlow Digital, LLC (“FFD,” “we,” “us,” or “our”) and you (“you” or “User”). They govern your access to and use of the Website and any products, digital downloads, consultations, coaching, and services we offer (collectively, the “Services”).
By using the Services, you agree to these Terms. If you don’t agree, don’t use the Services.
2) Eligibility & Changes
Eligibility. You must be 18+ to use the Services.
Updates. We may change these Terms from time to time. We’ll update the “Last Updated” date when we do. Your continued use means you accept the changes.
3) Accounts & Security
Some features may require an account (including client portals hosted in GoHighLevel). You’re responsible for:
Keeping your login safe;
All activity under your account;
Not sharing your login; and
Telling us ASAP if you suspect unauthorized access.
We may suspend or terminate accounts for violation of these Terms.
4) What We Actually Do Here (Scope of Services)
FFD provides:
Digital products and downloads;
Strategy sessions, coaching/consulting;
Marketing automation and CRM implementation services (including white-labeled GoHighLevel);
SMS programs (transactional and promotional—opt-in based); and
AI-assisted features (e.g., chat/voice agents, content suggestions).
We may update, add, or remove features without notice.
5) Purchases, Subscriptions & Refunds
Payment Processing. Payments are handled by third-party processors (e.g., Stripe/PayPal/Intuit). We don’t store card numbers.
Taxes. You’re responsible for any applicable taxes and fees shown at checkout.
Delivery. Digital items are typically delivered by email/link; services by agreed scope.
Subscriptions. If you buy a subscription, it auto-renews unless you cancel before the next billing cycle. Cancel in your portal or by contacting us.
Refunds. Unless stated on a specific sales page or order form, all sales are final for digital products, services, and time-based consulting. We may grant a goodwill refund at our sole discretion.
6) Acceptable Use
You agree you will NOT:
Break the law or violate others’ rights;
Upload malicious code or try to hack, scrape, or overload the site;
Impersonate a person or brand;
Spam or harass anyone;
Try to reverse engineer our Services;
Use our Services to build a competing offering.
7) Intellectual Property
All content, branding, copy, code, templates, and materials on or delivered through the Services are owned by FFD or our licensors and are protected by IP laws. We grant you a limited, revocable, non-transferable license to access the Services for your personal or internal business use. No resale, redistribution, sublicensing, or derivative works without our written okay.
8) User Content (If/When You Post or Upload)
If our Services allow you to submit content (e.g., intake forms, assets for implementation, or portal uploads), you:
Represent you have the rights to that content;
Grant us a license to use it solely to provide the Services to you; and
Agree your content won’t be illegal, infringing, or harmful.
We may remove content that violates these Terms.
9) SMS/Text Messaging Terms (A2P/10DLC-Compliant)
Program Description. With your opt-in, we may send SMS/MMS for: appointment reminders, service updates, receipts/alerts, and promotions (only if you opted in). Message frequency varies.
Opt-Out. Reply STOP to any message to unsubscribe. We’ll confirm and stop texting you.
Help. Reply HELP for assistance or contact [email protected] or (737) 252-1705.
Rates. Standard message/data rates may apply. Carriers aren’t liable for delayed/undelivered messages.
Privacy. We do not sell or share SMS opt-in data or phone numbers with third parties for their marketing. We share only with providers necessary to deliver texts. See our Privacy Policy for details.
Texas Marketing Quiet Hours. For Texas residents, we do not send marketing SMS/MMS outside 9:00 p.m.–9:00 a.m. (Mon–Sat) or before 12:00 p.m. or after 9:00 p.m. on Sundays. Transactional/service messages may be sent outside these times where permitted by law. ListrakAMB Interactive
Texas Do Not Call & Identification. We honor the Texas state Do Not Call rules and will not send solicitation texts to numbers listed on the Texas DNC registry. 10) AI-Assisted Features (Plain-English Version)
We use AI tools (text/voice/chat) to enhance support and delivery. AI may analyze interactions to personalize or improve service.
You may sometimes interact with AI instead of a human.
AI can be wrong; review outputs before relying on them.
You can request human assistance at any time.
We may use transcripts/interaction data to improve systems, per our Privacy Policy.
Don’t use our AI to break laws, impersonate people, generate harmful content, or build a competing model/service.
11) White-Labeled GoHighLevel (GHL) Services
We offer client portals and CRM services via GoHighLevel under our brand. Heads-up:
GHL is a third-party platform owned/operated by GoHighLevel.
Platform issues (downtime, feature changes, data incidents) are under GoHighLevel’s control, not ours.
Your use of GHL features is also subject to GoHighLevel’s own terms and privacy policy.
For core platform problems, you may need to contact GoHighLevel directly.
We’ll always act reasonably and help where we can, but we can’t guarantee GHL uptime or feature continuity.
12) Third-Party Links/Tools
We may link to or integrate with third-party sites and tools. We’re not responsible for those sites/tools, their content, policies, or availability. Use them at your own risk.
13) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES (EXPRESS OR IMPLIED), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don’t guarantee error-free operation, uninterrupted availability, perfectly accurate AI outputs, or specific results.
14) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FFD AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS/REVENUE; LOSS OF DATA; OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO FFD IN THE PRECEDING 6 MONTHS OR (B) $100. Some places don’t allow these limits—if that’s you, the limits apply to the maximum allowed.
15) Indemnification
You agree to defend, indemnify, and hold FFD (and our directors, officers, employees, and contractors) harmless from claims, losses, and costs (including reasonable attorneys’ fees) arising from: (a) your use of the Services; (b) your breach of these Terms; or (c) your infringement of third-party rights.
16) Governing Law, Venue & Arbitration
Governing Law. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules.
Arbitration & Class-Action Waiver. Any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by the AAA under its Commercial Rules in Travis County, Texas before a single arbitrator. No class actions or consolidated proceedings. Each party pays its own fees unless the arbitrator rules otherwise.
Small-Claims Option. Either party may bring an individual action in small-claims court in Travis County, Texas, instead of arbitration.
17) Termination
We may suspend or terminate your access at any time for any reason (including policy violations). You may stop using the Services at any time. Sections that logically survive termination (IP, disclaimers, limits of liability, arbitration, etc.) will survive.
18) Miscellaneous
Severability. If a clause is unenforceable, the rest still stands.
No Waiver. If we don’t enforce a term, that’s not a waiver of it.
Assignment. You can’t assign these Terms without our consent. We can assign them as part of a merger, acquisition, or asset sale.
Entire Agreement. These Terms + any order form/scope + our Privacy Policy = the whole deal between us.
